1. Agreement to Terms

By accessing or using the services provided by Avant Digital Group ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

2. Services

Avant Digital Group provides digital services including, but not limited to:

• Custom website design and development
• AI assistant development and integration
• Website hosting, maintenance, and optimization
• Consultation and strategy services

Specific deliverables, timelines, pricing, and scope are defined in individual project agreements or subscription plans.

3. Client Responsibilities

By working with Avant Digital Group, you agree to:

• Provide accurate, complete, and timely information
• Respond to communications, approvals, and feedback promptly
• Supply all required content, assets, and access credentials
• Review and approve deliverables within agreed timeframes
• Make payments according to agreed terms

Delays caused by missing information or approvals may affect project timelines.

4. Payment Terms

Payment terms are defined in your project agreement or subscription plan.

• Deposits, setup fees, or initial payments may be required before work begins
• Ongoing services may be billed on a recurring monthly basis
• Late or failed payments may result in paused services or suspension of access
• All fees are non-refundable unless otherwise stated in writing

5. Intellectual Property

Upon full payment:

• You own the final, custom deliverables created specifically for your project
• Avant Digital Group retains ownership of internal tools, templates, systems, frameworks, and processes
• We reserve the right to display completed work in our portfolio and marketing materials

Third-party assets (including fonts, plugins, stock media, AI tools, APIs, and hosting services) remain subject to their respective licenses and terms.

6. AI & Third-Party Services

Our services may rely on third-party platforms, including AI providers, hosting services, and APIs. Avant Digital Group is not responsible for:

• Downtime, changes, errors, or limitations imposed by third-party services
• Outputs generated by AI systems beyond our direct control

AI-powered features are provided "as is" and do not guarantee accuracy or specific outcomes.

7. Revisions & Scope

The number of revisions included is defined per project or plan.

• Requests outside the original scope may require additional fees
• Significant changes may require a revised agreement, pricing, or timeline

8. No Guarantees

While we design systems using proven best practices, Avant Digital Group does not guarantee specific results, including but not limited to revenue, conversions, rankings, traffic, or business performance.

9. Limitation of Liability

To the maximum extent permitted by law:

• Avant Digital Group shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount paid for the specific service giving rise to the claim

10. Termination

Either party may terminate services with written notice.

• Payment is due for all work completed up to the termination date
• Deposits and completed billing periods are non-refundable unless otherwise agreed in writing

11. Confidentiality

We agree to keep all client information confidential and will not disclose proprietary information without consent, except as required by law.

12. Changes to Terms

We reserve the right to update these Terms of Service at any time. Continued use of our services constitutes acceptance of the revised terms.
